1. General provisions
These Terms of Service (the «Agreement») govern the relationship between the Operator — Самозанятый (плательщик налога на профессиональный доход), Павлович В.В. (the «Operator», «we») and the natural person (the «User», «you») using the UptimeDog service.
The service is available on the website uptimedog.org and in the Telegram bot @UptimeDogBot. Using the service means full and unconditional acceptance of this Agreement.
2. Definitions
- Service — the UptimeDog software suite providing monitoring of HTTP availability of sites, SSL certificates and domains.
- Account — a record in the system associated with the user's Telegram ID or email.
- Free — a free plan with limited functionality.
- Premium — a paid subscription with extended capabilities.
- Telegram Stars (XTR) — Telegram's internal currency used to pay for the subscription and donations.
3. Registration and account
Using the basic functionality is possible after authorizing via Telegram or Google. The user undertakes to provide accurate information and not to share access to their account with third parties.
The service is intended for persons who have reached the age at which they can independently enter into contracts under the laws of their country (in Russia — 14 years with the written consent of legal representatives, 18 years — independently).
4. Service description
UptimeDog automatically checks the availability of the web resources specified by the user and notifies them of events (an outage, recovery, the upcoming expiry of an SSL certificate or domain) via the Telegram bot.
We strive to keep the service running smoothly, but we don't guarantee absolute uptime. Scheduled work and incidents are published on the service status page.
5. Plans and payment
5.1. Free
- Up to 3 sites per account.
- Checks no more often than once every 3 minutes.
- Basic notifications and statistics.
5.2. Premium
- Up to 50 sites per account.
- Configurable check interval from 30 seconds to 1 hour.
- Extended statistics, domain and DNS monitoring, priority support.
5.3. Payment
Premium and donations are paid in Telegram Stars (XTR) via Telegram's payment infrastructure. The Operator does not receive or store bank card details. Current prices are shown in the bot (the /profile command) and on the pricing page.
5.4. Refunds
Refunds for Telegram Stars payments are governed by Telegram's rules. We're ready to assist in disputed situations — write to support@uptimedog.org with a description of the problem and the transaction ID.
6. Rules of use
The user undertakes to:
- use the service only to monitor resources that belong to them or that they have permission to monitor;
- not use the service to organize load testing of others' sites, DDoS attacks or other unlawful actions;
- not bypass plan limits by technical means;
- not share account access with third parties;
- comply with the laws of Russia and the jurisdiction in which they are located.
7. Intellectual property
All rights to the software, design, texts, logo and other elements of the service belong to the Operator or its licensors. The user is granted a non-transferable right to use the service within the functionality of the chosen plan.
8. Liability
The service is provided «as is». The Operator is not liable for:
- lost profits or other indirect losses caused by unavailability of the service;
- actions or inaction of third parties, including hosting providers and Telegram;
- unlawful actions of the user or third parties in relation to their account.
The Operator's aggregate liability to the user is limited to the amount paid by the user over the last 12 months of Premium use, but no more than the equivalent of 5,000 ₽.
9. Suspension and termination of use
The Operator may suspend or terminate the provision of the service in case of a breach of the Agreement, with notice to the user via the available communication channels.
The user may discontinue use of the service at any time and request deletion of their account by writing to support@uptimedog.org.
10. Dispute resolution
The laws of the Russian Federation apply to the Agreement. Disputes are resolved through negotiations; if agreement cannot be reached — in court at the Operator's location, subject to a mandatory pre-trial claim procedure (the term for responding to a claim is 30 calendar days).
11. Changes to the agreement
The Operator may amend the Agreement. The current version is published at /docs/terms. Material changes are additionally announced via the Telegram bot or the web panel. Continued use of the service after changes are published means acceptance of the new version.
