1. General provisions
UptimeDog respects the rights of rightsholders and is ready to promptly review claims of infringement of copyright, related and other intellectual property rights connected with the use of the service.
The service itself does not store or distribute user content: we monitor the availability of URLs specified by users. If you believe that our service provides access to materials infringing your rights, send a notice to the contacts below.
2. Notice of infringement
For a notice to be reviewed, it must contain:
- information about the claimant: full name or organization name, email address, contact phone (optional);
- confirmation that the claimant is the rightsholder or an authorized representative of the rightsholder, stating the grounds (a document, a power of attorney);
- a description of the protected object and the rights to it (a work, a trademark, etc.);
- the specific URLs or UptimeDog user identifiers being complained about;
- a good-faith statement: «I confirm that the information in this request is accurate and I act in good faith»;
- the claimant's signature (electronic or scanned) and the date of the request.
Send the notice to dmca@uptimedog.org with the subject «DMCA / Rights». We aim to respond within 5 business days; in complex cases the term may be extended, with notice to the claimant.
3. Counter-notice
If a user believes the measures taken against them were taken in error or due to a wrongful complaint, they may send a counter-notice to the same address, stating:
- their contact details (Telegram ID or the email used in the service);
- links to the blocked content or functionality;
- a justification of why the block was wrongful, with supporting evidence (for example, licenses, permissions);
- a good-faith statement.
Based on the review of the counter-notice, appropriate measures are taken: restoring access or an additional request to the original complainant.
4. Repeat-infringer policy
User accounts that are the subject of repeated and confirmed complaints about infringement of third-party rights may have their use of the service restricted or be blocked without a refund of amounts paid.
5. Liability for knowingly false claims
Submitting a knowingly false notice may entail liability under the laws of the Russian Federation and/or the claimant's jurisdiction. The Operator may seek compensation for losses caused by bad-faith requests.
